Terms & Conditions
1. General
The offered prices are taken from the pricelist of the Kracher Fine Wine GmbH. Changes in price may occur due to currency fluctuations or misprints. All prices include taxes.
2. Offer
All offers are subject to alteration and without obligation, the last offer annuls all prior offers. Our website checks stock against our distribution centre stock at time of purchase so is not guaranteed as accurate in all circumstances. We reserve the right to reduce orders, without giving reasons, to allow all our customers to purchase our wines. Deliveries comply with our terms of delivery. Other agreements only apply if we approve them in writing.
3. Maturity
A buying contract comes into existence with confirmation of the order (via E-Mail, Phone or letter). We reserve the right to withdraw from contract, if there are printing, typesetting or calculation errors on our store pages.
4. Delivery & Shipping
We offer packets for six and twelve bottles, therefor we recommend orders which are divisible by 6. Shipping costs are charged for each package separately. Orders with less than six bottles, are charged with the shipping cost for six bottles. You can look up the shipping prices in our shipping pricelist. For all articles categorised NO WINES, we charge 1€ per article for shipping in Austria and Germany, all other countries we charged a fee of 2€ per article.
Delivery to Austria and Germany:
Orders with value above € 99, delivery is free of charge in Austria and value above €150, free of charge in Germany. For delivery in other countries, we can assume the cost just partially. We will inform you after you place your order.
Delivery to Switzerland:
The delivery cost covers the delivery cost including the administration fee. You’re obligated to pay import VAT (7%) and import duty directly to the forwarding agency.
5. Transportdamage
Fee and risk are bound to the buyer, from the moment on, the delivery leaves the Storage Illmitz. International trade practice following, we refuse to provide replacement for individual wines with cork taint.
6. Reservation of ownership
Until complete payment of all our claims (including interest and fees), all commodities remain property of Kracher Fine Wine GmbH.
7. Price
Prices are in Euro, per bottle, including all fees and taxes for customers in Austria. Deliverys outside of Austria can lead to changes in prices, due to different fees and taxes.
Not included in prices are charges accuring while transport.
Although we endeavour to ensure that all pricing information on this website is accurate, occasionally an error may occur and goods may be mis-priced. We reserve the right not to accept any order.
8. Right to withdrawal
If you are a customer according to the law and have place an order with distance selling, via post, Phone, E-Mail or our online store (www.finewineshop.com) you have the right to withdrawal from this contract within 14 days without giving any reason (§§ 11 FAGG). To exercise the right of withdrawal you must inform us in writing (Post, Fax, E-Mail) or return the commodities to us. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal or the goods before the withdrawal period has expired

Effects of withdrawal:
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by Kracher Fine Wine GmbH), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
9. Warranties
International trade practice following, we refuse to provide replacement for individual wines with cork taint. Unwanted commodities can be sent retour within three months and at expense of the buyer, if commodities are intact. We will not sell or deliver alcohol to anyone who is, or appears to be, under the age of 18. By placing an order you confirm that you are at least 18 years old and we reserve the right not to deliver if we are unsure of this.
10. Severability
If a provision of this Agreement is or becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect the validity or enforceability in that jurisdiction of any other provision of this Agreement.
11. Place of jurisdiction
Place of fulfilment is Illmitz. For all disputes arising from this contract, both parties agree to the district court Neusiedl am See as place of jurisdiction.
